While Commissioner Andriukaitis asserted he demands full transparency on the glyphosate file, he should be consequent with his statements and consider withdrawing the Commission appeal against Greenpeace and PAN Europe on the glyphosate case.

subject: Withdrawing appeal against Greenpeace and PAN Europe on the glyphosate issue (Case T 545/11)

Dear Commissioner Andriukaitis,

As you mentioned it on 4 April 2016 in a letter addressed to Mr Richard P. Garnett in charge of the regulatory affairs at Monsanto and Chair of the Glyphosate Task Force, « the glyphosate authorisation process has drawn an extraordinary degree of public attention and concerns, particularly in the European Parliament, about the transparency of the European assessment process. »

In your willingness to assure transparency, you concluded your letter by asking Richard Garnett to publish the raw data of the studies on glyphosate.

In 2011 Greenpeace also demanded that full light be shed regarding glyphosate and all the studies which led to the marketing authorisation of this substance. As this request was not taken into consideration, Greenpeace Nederland and Pesticide Action Network Europe sued the Commission which was condemned by the second chamber of the European Court of Justice in October 2013 . The Commission appealed to this decision and the judgment is still pending.

In order to be fully consequent in your fight for transparency, which you reasserted during our latest group meeting on 12 April, we ask you to withdraw the appeal of the Commission so full light can be shed on the studies on which EFSA based its work to re-evaluate the glyphosate.

Under articles 148 and 190 of the European Court of Justice’s rules of procedure, you are entitled to withdraw such an appeal.

Yours sincerely,

Michèle Rivasi
